Deferred Disposition VS Defensive Driving

The Municipal Court will try to get you to take "Deferred Disposition" (AKA Deferred Adjudication) before they tell you about the Defensive Driving option By Texas law long as you qualify, they cannot refuse you the lower cost defensive driving option.

The reason being is that their deferred disposition cost you MORE and the municipal court get to keep ALL of that fee and send nothing to the State of Texas.  On the hand hand, with defensive driving they can't charge you as much and a small portion of the court fee they collect from you goes to the state.  Therefore the court keeps much less.

Either option above will dismiss the traffic citation then and there, but it's all about the money.


Texas Qualifications for for Defensive Driving (AKA Driving Safety)

Most minor traffic tickets can be dismissed with a Texas defensive driving course. A Texas defensive driving course may NOT be taken to dismiss any of the following violations:

  • Speeding at or more than 25 MPH over the posted speed limit
  • No car insurance
  • Leaving the scene of an accident (hit and run)
  • Passing a school bus
  • Construction zone violations

You can take a Texas defensive driving course if you meet the following conditions:

  • You have not taken a defensive driving course within the past 12 months.
  • Do not have a commercial driver’s license (CDL)
  • Are not currently taking a defensive driving course for a different violation.

Austin Texas Defensive Driving Program

 Austin Texas defensive driving course is for both traffic ticket/citation dismissals and for an auto insurance discount.  Many Texas municipal city courts and county justice of the peace (JP Precinct) courts will first offer a violator deferred adjudication.  The deferral option will keep the traffic ticket off your driving record if you don't get another ticket in 12 months.  The problem with that option is that the court costs are nearly as high as the ticket fine itself or even more .

You generally have to request the Austin municipal court to allow you to take the defensive driving option instead.  Our Texas TDLR approved defensive driving course is very low cost, and the court fee is much lower too.  It will save you half the cost of a court deferred adjudication/diversion, deferral PLUS you can take an insurance discount through most car insurance providers.  Your auto insurance company will not even know you took the course for a traffic ticket.  They will only see that you took a defensive driving course and you reap the discount!

The defensive driving course option MUST be allowed by all courts IF you get a moving violation ticket and you have not taken a defensive driving course in the past 12 months for another traffic charge

Moving violations are speeding, running a red light, stop sign, fail to yield right of way, following too closely charges, etc.

Speeding tickets are allowed and by far exceed all other charges.  As long has your charged speed does not exceed 25 mph over the posted speed limit, the courts have to allow you to take a DDC course for dismissal in the state of Texas.

Drivers education are offers for teens age 14-18 and slightly different program for adults over the age of 18.  The drivers education programs can be either the parent taught and online version or the behind the wheel and in the car instructor option after completion of the online class.  The choice is yours to make.

Seniors Age 55 Insurance Discount Class

The Texas mature driver improvement course is for senior drivers age 55 and older.  Most major auto insurance providers allow up to a 15% discount off you existing car insurance policy with the completion of this easy online course.

Texas Seat Belt | Child Car or Booster Seat Restraint

 In Texas, the law requires everyone in a vehicle to buckle up or face fines and court costs up to $200. Children younger than 8 years must be in a child safety seat or booster seat unless they're taller than 4 feet 9 inches. If they aren't properly restrained, the driver faces fines up to $250, plus court costs.

Municipal Courts and County JP Precinct Courts will allow those with violator tickets to take the special seat belt course below.
